Proposed remake of the NHMRC Regulation 2016
Overview
The National Health and Medical Research Council (NHMRC) proposes to remake the National Health and Medical Research Council Regulation 2016 (the Regulation), which is due to sunset on 1 October 2026.
Sunsetting is the automatic repeal of legislative instruments after a fixed 10-year period. All legislative instruments are subject to sunsetting unless they are exempt. The purpose of sunsetting is to ensure that legislative instruments are kept up to date and only remain in force for so long as they are needed.
The Regulation prescribes certain matters relating to consultation about regulatory recommendations, guidelines, and interim regulatory recommendations and guidelines under the National Health and Medical Research Council Act 1992 (the Act).
NHMRC has assessed that the Regulation operates effectively and is an important and useful part of the legislative framework. It is proposed that the Regulation be replaced by a new regulation that is substantially the same.
Changes to the Act are not within scope of this consultation. No amendments to the Act are proposed at this time.
